1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of HAF ACE (the "Service"), operated by Parity Platform P.C. (operating brand "EV Loader"), a Greek private company with VAT EL997031706, registered at Dolianis 29, Marousi, 15124, Greece ("we", "us", "our"). By creating an account, accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

HAF ACE is an arcade flight game played in a web browser through this website and in the HAF ACE mobile apps. Parts of the game may be offered free of charge, such as the tutorial and the first mission in the mobile apps; the full game is unlocked by the purchase described in section 4. The missions, modes and features of the game may change over time at our discretion.

3. Eligibility and Account

You must be at least 16 years old to create an account. You are responsible for the accuracy of the information you provide and for keeping your credentials confidential. You are responsible for all activity that occurs under your account. Your account is a single account for the games we operate, currently HAF ACE and Motor Game: the same sign in works in each of them, while purchases stay with the game they were made for. Deleting your account deletes it for all of our games.

4. Full Game Unlock, Price and Payment

The full game is unlocked by a single purchase (the "Full Game Unlock"). It is not a subscription, it does not renew and you are never charged for it again. The price, including VAT, is shown before you pay. On this website payments are processed by Stripe, and in the mobile apps by Google Play or the Apple App Store, each under its own terms. The Full Game Unlock belongs to your account and gives access to the full game for as long as we offer the Service, wherever you sign in with that account; a purchase made in a mobile app is also restored by that store on your devices. We may offer promotion codes, including codes that unlock the game free of charge; codes are personal, have no cash value and may be limited in number or time.

5. Refund Policy

Where mandatory law gives you a right of withdrawal (including the EU consumer right of withdrawal), you may withdraw within fourteen (14) days of the purchase and receive a refund, provided you have not started the unlocked game. Before you pay, you expressly request immediate access to the digital content and acknowledge that you lose the right of withdrawal once you start the unlocked game; for a paid purchase we confirm this in your receipt email.

No refunds are offered once the unlocked game has been used. Used means starting any mission or mode after the purchase. Purchases made in a mobile app are refunded only under the refund rules of that store. If a payment is refunded or reversed, the Full Game Unlock is removed.

6. Acceptable Use

You agree not to (a) reverse engineer, scrape, or attempt to extract source code, artwork or underlying ideas from the Service; (b) use the Service to violate any law or third party right; (c) interfere with the Service or access it through unauthorised means; (d) share your account credentials or resell access to the Service; (e) share, sell or misuse promotion codes. We may suspend or terminate accounts that breach these rules without refund.

7. Intellectual Property

All content, artwork, software, branding and game logic that make up the Service are owned by Parity Platform P.C. or its licensors and are protected by intellectual property laws. We grant you a limited, non exclusive, non transferable, revocable licence to access and use the Service for personal, non commercial entertainment purposes for as long as you have access to it. The Service is inspired by historical events; references to real people, military units, aircraft and insignia are descriptive and do not imply endorsement by anyone.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the Service will be uninterrupted, error free, or free from harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, Parity Platform P.C. and its affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Service. Our total aggregate liability for any claim arising under these Terms shall not exceed the amount you paid us for the Full Game Unlock. Nothing in these Terms limits liability that cannot be limited under applicable law (such as for gross negligence, wilful misconduct, or harm to life, body or health).

10. Termination

You may stop using the Service at any time and delete your account on the Get HAF ACE page or in the app. Deleting your account deletes it for all of our games, cancels any subscription you hold with us for another of our games, and removes a Full Game Unlock bought on this website; a purchase made in a mobile app store stays with your store account. We may suspend or terminate your access immediately if you breach these Terms. Sections that by their nature are intended to survive termination (intellectual property, disclaimers, liability, governing law) will continue in effect.

11. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. Material changes will be notified by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Greece, without regard to its conflict of laws rules. Any dispute shall be subject to the exclusive jurisdiction of the courts of Athens, Greece, without prejudice to any mandatory consumer protection rights you may have in your country of residence. Consumers may also turn to the Hellenic Consumer Ombudsman for out of court resolution of disputes at synigoroskatanaloti.gr.
